These Terms of Service ("Terms") govern your access to and use of the websites, hosting offerings, client portal, and related services (collectively, the "Services") provided by 2ndlifetech ("2ndlifetech," "we," "us," or "our"). Our primary website is available at https://www.2ndlifetech.com/.

By accessing or using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy (AUP). If you purchase or use paid hosting or related client services, our Client Services Contract also applies. If you do not agree, do not use the Services.

1. Acceptance of Terms

These Terms form a binding agreement between you and 2ndlifetech. Your use of the Services also constitutes acknowledgment of our Privacy Policy, which describes how we collect and process personal information (including portal compliance-related identifiers, IP address, consent timestamps, and—with your permission—geolocation), and of our AUP, which sets rules for permitted and prohibited use.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

2ndlifetech provides web hosting and related technology services, including public websites, subscription-based hosting plans, customer support channels, and a client portal through which eligible customers may manage aspects of their account, files, tickets, or related features. Features may change over time as we improve or maintain the Services.

We may offer different plan tiers, storage or resource limits, and optional features. Specific plan details shown at purchase or on our hosting pages form part of your commercial arrangement with us, subject to these Terms and the AUP.

3. Eligibility and Accounts

Consistent with our Privacy Policy, the Services are not directed to children under 18 years of age. By using the Services, you represent that you are at least 18 years old, or that you are the parent or guardian of a minor and consent to that minor’s use where applicable under our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at seccondlifetech@hotmail.com if you suspect unauthorized access. Sharing portal credentials, attempting to access another user’s account, files, or disk space, or otherwise circumventing authentication or security controls is prohibited under the AUP and may result in suspension or termination.

Information you provide in connection with your account or purchases must be true, complete, and accurate, and you must keep it updated. For paid hosting and related client services, you may be required to provide a completed IRS Form W-9 (or an acceptable substitute) as described in our Client Services Contract. Failure to provide requested tax documentation may delay activation or related account processing.

4. Payments and Billing

Paid Services are billed according to the plan you select. Payment processing is handled by PayPal. We do not store full payment instrument numbers on our systems; payment data is handled and stored by PayPal as described in our Privacy Policy. PayPal’s own terms and privacy notice also apply to transactions you complete through PayPal.

Subscriptions typically renew on a recurring basis (for example, monthly) until cancelled in accordance with the cancellation methods we make available or through your PayPal account settings. Fees are generally non-refundable except where required by law or expressly stated by us in writing. You are responsible for applicable taxes.

Failure to pay amounts due may result in suspension or termination of paid Services, including portal access to hosted resources associated with the unpaid account.

5. Acceptable Use

Your use of the Services must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Without limiting the AUP, you may not use the Services for illegal activity, security abuse, spam, malware distribution, copyright or trademark infringement, harassment, unauthorized cryptocurrency mining, excessive resource consumption that harms other customers, or attempts to bypass security, lockouts, or compliance controls.

6. Intellectual Property

The Services, including our websites, branding, software, documentation, and related materials (excluding content you upload), are owned by 2ndlifetech or its licensors and are protected by applicable intellectual property laws. Except for the limited right to use the Services as expressly permitted by these Terms, no license is granted to you.

You may not copy, modify, distribute, reverse engineer (except to the extent such restriction is prohibited by law), or create derivative works from our proprietary materials without our prior written consent.

7. Your Content and Responsibility

You retain ownership of content you upload to hosting or portal storage. You are solely responsible for that content, including backups you choose to maintain, and for ensuring you have all rights necessary to store and process it through the Services. You grant us a limited license to host, store, transmit, and display your content solely as needed to operate and support the Services.

We may remove or disable access to content that violates these Terms, the AUP, or applicable law, or that creates security or operational risk.

8. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, completely secure, or free of harmful components. As noted in our Privacy Policy, no electronic transmission or storage system can be guaranteed to be 100% secure. You are responsible for maintaining appropriate security practices for your own devices, accounts, and content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL 2NDLIFETECH OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Termination and Suspension

You may stop using the Services at any time and may cancel paid subscriptions through the mechanisms we provide or via PayPal as applicable.

We may suspend or terminate your access to some or all of the Services immediately, with or without notice, if we reasonably believe you have violated these Terms or the AUP, pose a security risk, fail to pay fees when due, or if required by law. Upon termination, your right to use the Services ceases. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and governing law) will survive termination.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated date at the top of this page. Material changes may be highlighted on the website or otherwise communicated when appropriate. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires a different process.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Subject to applicable law, you agree that courts located in New York shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, except that we may seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property or Services.
